Individuals who have a commercial driver’s license (CDL) are governed under the Department of Transportation (DOT) guidelines as safety-sensitive transportation employees (CFR Part 40.1.b). Under the guidelines, anyone who tests positive on a drug test is required to participate in a Substance Abuse Evaluation and follow the treatment recommendations prior to returning to a safety sensitive position. These evaluations are completed by a Substance Abuse Professional (SAP) (CFR 40.291). The SAP evaluator must do the following:

  • Make a face-to-face clinical assessment and evaluation to determine the extent of the substance abuse problem if any, and to determine what assistance is needed to resolve problems associated with alcohol and/or drug use;
  • Provide a referral to an appropriate education and/or treatment program;
  • Conduct a face-to-face follow-up evaluation to determine if the individual has actively participated in the education and/or treatment program and has demonstrated successful compliance with the initial assessment and evaluation recommendations;
  • Provide the employer with a follow-up drug and/or alcohol testing program;
  • Provide the employer and the individual with recommendations for continuing education and/or treatment as appropriate.

The SAP does not make a recommendation about whether or not the individual is ready to return to work. That determination is made by the employer. It is the role of the SAP to determine whether the individual is in compliance with the education and/or treatment recommendations.

The SAP is not an advocate for either the individual or the employer. The SAP’s role is to protect the public interest in safety related to transportation employers and transportation employees in safety sensitive positions.
